Adventures in Egypt is the trading name of the above-named self-employed provider/freelancer.
Hereinafter referred to as "Adventures in Egypt", "we", "us" or "provider".
2. Scope
These T&Cs apply to all bookings, inquiries, brokerage and organisational services in connection with excursions, tours, transfers, activities and other tourist services offered or arranged through Adventures in Egypt.
Bookings can be made in particular via:
- our website
- a contact or booking form
- phone
- social media
- in-person booking on site
These T&Cs apply both to bookings by guests in Egypt and to bookings by guests who book before their trip from Germany, Austria, Switzerland or any other country.
3. Role of Adventures in Egypt as Freelancer and Broker
Adventures in Egypt is a self-employed provider/freelancer and acts, unless expressly agreed otherwise, as broker and organisational contact for excursions and tourist services in and around Hurghada.
Individual excursions and tourist services may be carried out by local service partners, for example:
- Drivers and transfer companies
- Guides
- Boat operators
- Dive centres
- Snorkelling providers
- Safari providers
- Quad or buggy providers
- Hotels, meeting point coordinators or other local service providers
Where legally required, individual services are performed by appropriately licensed or certified local service partners.
Adventures in Egypt is not automatically the organiser of every individual service arranged. The specific role of Adventures in Egypt as broker, organisational contact or direct service provider follows from the respective excursion description, booking confirmation or individual agreement.
4. Formation of Contract
The presentation of excursions on our website, social media, messages or advertising materials does not constitute a binding offer to conclude a contract.
A binding contract for brokerage or organisational services is formed when:
- the customer submits a booking inquiry or booking, and
- Adventures in Egypt expressly confirms the booking.
Confirmation may be given in particular via WhatsApp, email, phone, contact form, social media or in person.
Where the actual conduct of the excursion is carried out by a local service partner, an additional service relationship may arise between the customer and the respective local service partner. Adventures in Egypt remains the contact for organisation and communication unless otherwise agreed.
5. Customer Information
The customer undertakes to provide complete and accurate information when booking. This includes in particular:
- Name
- Phone number or WhatsApp contact
- Email address where required
- Number of participants
- Travel date
- Desired excursion
- Hotel, accommodation, pickup location or meeting point
- Special notes, e.g. allergies, health limitations, pregnancy, mobility restrictions or participation of children
The customer is responsible for ensuring that Adventures in Egypt receives all information necessary for the brokerage, organisation and conduct of the excursion in good time.
6. Prices
The prices applicable are those stated at the time of booking and confirmed by Adventures in Egypt. All prices are per person or per booked group unless otherwise stated.
The price includes only the services expressly listed in the respective excursion description or booking confirmation.
Not included in the price are in particular personal expenses, tips, additional drinks, additional activities, official fees, entrance fees or special services, unless expressly stated as included.
7. Payment
Payment may be made, depending on agreement, by:
- Cash payment
- PayPal
For cash payments, the agreed amount is due at the latest before the start of the excursion or at the individually agreed time.
For PayPal payments, Adventures in Egypt may require advance payment or a deposit. A booking may be made conditional on timely payment or deposit.
Any fees, currency conversions or costs of the payment provider may be borne by the customer, provided this was communicated transparently before or at the time of booking.
8. Scope of Services
The specific scope of services follows from the respective excursion description and booking confirmation. Depending on the excursion, services may include:
- Transfer, guide and pickup
- Boat trip and snorkelling or diving equipment
- Safari vehicle, catering and admission
- Programme activities and return journey
The individually confirmed booking is always definitive.
Minor changes to the schedule are possible, provided they do not substantially alter the overall character of the excursion and are required for organisational, weather-related, safety or regulatory reasons.
Where individual services are provided by local partners, the safety, participation and operational requirements of the respective local service partner also apply.
9. Pickup, Meeting Point and Punctuality
The customer is obliged to be punctual at the agreed pickup location or meeting point.
Pickup times may shift slightly due to traffic, hotel procedures, weather, official checks, safety requirements or the pickup of other guests.
If the customer does not appear or is significantly late without notifying Adventures in Egypt in good time, this may be treated as a no-show. In this case, no refund is owed, provided Adventures in Egypt or the local service partner is not responsible for the delay or non-appearance.
10. Changes by the Customer
Change requests by the customer must be communicated to Adventures in Egypt as early as possible.
We will endeavour to accommodate change requests, but there is no entitlement to changes.
Changes may result in additional costs, in particular if local partners, vehicles, boats, guides, tickets, permits or special services have already been firmly booked.
11. Cancellation by the Customer
The customer may cancel a booking before the start of the excursion. Cancellation must be made clearly via WhatsApp, email or the communication channel through which the booking was confirmed.
Unless a different cancellation policy was agreed at booking, the following cancellation conditions apply:
| Cancellation time | Cancellation fee |
|---|---|
| Up to 48 hours before start | Free of charge |
| Less than 48 hours before start | Up to 50% of the agreed price |
| Less than 24 hours before start or no-show | Up to 100% of the agreed price |
Costs already incurred that are non-refundable, such as tickets, permits, boats, external service partners, private transfers or special services, may be charged regardless of the time of cancellation, provided the customer was informed of these costs or they were necessary due to the specific booking.
12. Cancellation for Private Tours, Group Bookings and Special Services
Different cancellation conditions may apply to private tours, group bookings, individually organised excursions, special requests or services with external partners.
Such different conditions will be communicated to the customer before or at the time of booking confirmation.
For individually organised services, higher cancellation costs may arise if local partners, vehicles, boats, guides, tickets or permits have already been firmly reserved or paid for.
13. Cancellation or Change by Adventures in Egypt or Local Service Partners
Adventures in Egypt or the respective local service partner may change, postpone or cancel an excursion if its conduct is not possible or not reasonable for important reasons. Important reasons include in particular:
- Bad weather, sea conditions or wind
- Safety risks or official orders
- Road closures or technical problems
- Illness or absence of a guide, driver or local partner
- Failure to reach a required minimum number of participants
- Force majeure or other circumstances outside our control
In this case, we will offer the customer an alternative date, an equivalent alternative or a refund of amounts already paid where possible.
Further claims exist only where Adventures in Egypt is responsible for the cancellation.
14. Weather, Safety and Programme Changes
Excursions in Egypt may be affected by weather, sea conditions, wind, visibility, desert conditions, traffic, official requirements and security situations.
Adventures in Egypt and the deployed guides, drivers, crews or local partners may change, shorten, postpone or omit individual programme points for safety reasons.
The safety of guests takes priority over the full execution of the originally planned programme.
15. Health Requirements and Personal Responsibility
The customer is personally responsible for being in suitable health to participate in the booked excursion. This applies in particular to:
- Snorkelling, diving and boat excursions
- Desert safaris, quad or buggy tours
- Longer transfers and activities in heat
- Activities with children
- Activities for pregnant persons or those with pre-existing conditions
Health limitations, allergies, pregnancy, mobility restrictions or other relevant circumstances must be communicated to Adventures in Egypt before the start of the excursion.
Adventures in Egypt or the respective local service partner may refuse participation where safety or health risks exist.
16. Participation of Children and Minors
Minors may only participate with the consent of parents, guardians or a responsible adult accompanying person.
Supervision of children during the excursion is generally the responsibility of parents, guardians or the responsible accompanying person, unless expressly agreed otherwise.
Age, height, weight or health restrictions may apply to certain excursions.
17. Conduct of Participants
Participants must follow the safety instructions of Adventures in Egypt, guides, drivers, boat crews, dive instructors, safari guides and local partners.
Participants may not endanger or damage other guests, staff, partners, animals, the environment, equipment or vehicles.
In the event of serious misconduct, intoxication, drug use, disregard of safety instructions or endangerment of others, Adventures in Egypt or the respective local service partner may exclude the participant from the excursion.
In this case, no refund is owed where the exclusion is attributable to the participant.
18. Identity Documents, Permits and Official Requirements
The customer is responsible for carrying valid travel documents, identification, visas or other required documents where these are necessary for the respective excursion.
Official permits, identity checks or security checks may be required for certain excursions.
If a customer is unable to participate due to missing or invalid documents, no refund is owed where Adventures in Egypt or the local service partner is not responsible.
19. Liability of Adventures in Egypt
Adventures in Egypt is liable for damages only in accordance with applicable law.
As a freelancer and broker, Adventures in Egypt is in principle liable for its own brokerage, organisational and communication errors, to the extent these are attributable to Adventures in Egypt.
For the proper performance of services carried out by independent local service partners, Adventures in Egypt is only liable where it bears its own fault under applicable law or where the conduct of the local service partner is legally attributed to Adventures in Egypt.
In cases of minor negligence, Adventures in Egypt is only liable for damages arising from the breach of material contractual obligations. Material contractual obligations are those whose fulfilment makes proper brokerage or organisation of the booked service possible in the first place and on whose observance the customer can regularly rely.
Liability for damages arising from injury to life, body or health, and for intentional or grossly negligent conduct, remains unaffected.
20. Exclusions of Liability
Adventures in Egypt is not liable for damages, delays or cancellations caused by:
- Force majeure, weather, sea conditions or official orders
- Traffic, strikes, political events or security situations
- Conduct, non-appearance or delay of the customer
- Incorrect or incomplete information provided by the customer
- Unauthorised departure from the group
- Disregard of safety instructions
- Actions or omissions of independent local service partners not legally attributable to Adventures in Egypt
These liability limitations do not apply to injury to life, body or health, nor to intentional or grossly negligent conduct.
21. Travel Insurance
Adventures in Egypt recommends that all customers take out appropriate travel insurance. Depending on the excursion, the following may be particularly advisable:
- International health and travel accident insurance
- Travel cancellation insurance
- Insurance for water sports, diving, snorkelling, quad or safari activities
- Luggage and valuables insurance
The customer is personally responsible for checking and arranging adequate insurance cover.
22. Luggage, Valuables and Personal Belongings
The customer is personally responsible for their personal belongings, valuables, cash, mobile phones, cameras, identification documents and other luggage.
Adventures in Egypt is not liable for loss, theft or damage to personal belongings, unless Adventures in Egypt caused the damage intentionally or through gross negligence.
We recommend taking only necessary items on the excursion and keeping valuables secure.
23. Photos and Videos
Photos and videos may be taken during excursions.
Photos or videos in which guests are recognisable and which are to be used for the website, advertising or social media such as Facebook, Instagram or TikTok will in principle only be used with the consent of the persons concerned, where legally required.
Consent given may be withdrawn at any time with effect for the future.
The customer may only take and use their own photos and videos in a way that does not infringe the rights of other guests, staff, guides or partners.
24. Third-Party Providers, Platforms and Payment Services
When using external services such as PayPal, WhatsApp, Facebook, Instagram, TikTok, Google Maps or YouTube, the terms of use and privacy policies of the respective provider also apply.
Adventures in Egypt has no full control over the data processing, availability or service conditions of external providers.
25. No Statutory Right of Withdrawal for Date-Specific Leisure Activities
When booking excursions, tours and leisure activities with a fixed date or period, there is generally no statutory right of withdrawal, to the extent applicable consumer law provides for a corresponding exception.
Under Art. 16(l) of the EU Consumer Rights Directive, an exception from the right of withdrawal applies to services related to leisure activities where the contract provides for a specific date or period of performance. The Court of Justice of the European Union has confirmed that this exception may also apply when sold through brokers under certain conditions.
The cancellation conditions set out in these T&Cs apply regardless.
26. Complaints and Notification of Defects
If a problem arises during the excursion, the customer must immediately notify the guide, driver, contact, local service partner or Adventures in Egypt, so that remedial action can be taken directly where possible.
Complaints after the excursion should be directed to Adventures in Egypt as quickly as possible by email or WhatsApp.
The customer should describe the matter as precisely as possible and, where available, include booking details, photos or other evidence.
27. Consumer Dispute Resolution
Adventures in Egypt is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless there is a mandatory legal obligation to do so.
The former EU Online Dispute Resolution platform was shut down on 20 July 2025. A link to this platform should therefore no longer be used.
28. Applicable Law
Contracts with Adventures in Egypt are in principle governed by the law of the Arab Republic of Egypt.
In relation to consumers, the protection afforded by the mandatory statutory provisions of the state in which the consumer is habitually resident remains unaffected, to the extent these provisions may not be excluded by choice of law under applicable law.
In particular, if Adventures in Egypt specifically targets consumers in Germany or the European Union, mandatory consumer rights of the consumer's country of residence may remain additionally applicable despite the choice of law. Under Art. 6 of the Rome I Regulation, a choice of law may not deprive consumers of the protection of mandatory provisions of their country of habitual residence.
29. Jurisdiction
To the extent permitted by law, the place of jurisdiction is the registered seat of Adventures in Egypt in Egypt.
In relation to consumers, this jurisdiction clause only applies to the extent permitted under applicable law.
Special rules on jurisdiction may apply to consumer contracts. Under Art. 18 of the Brussels Ia Regulation, a consumer may, under certain conditions, bring proceedings in the courts of their domicile; claims against consumers may generally only be brought in the member state of their domicile.
30. Data Protection
Information on the processing of personal data can be found in our Privacy Policy.
The Privacy Policy contains important information on the processing of booking, contact, payment and communication data.
31. Changes to these T&Cs
Adventures in Egypt may amend these T&Cs with effect for the future where this is required due to changes in law, changes to the services offered, technical developments or organisational adjustments.
Already confirmed bookings are generally governed by the T&Cs agreed at the time of booking.
32. Severability Clause
Should any provision of these T&Cs be or become wholly or partly invalid, the validity of the remaining provisions shall not be affected.
The invalid provision shall be replaced by the legally permissible rule that comes closest to the economic purpose of the invalid provision.
